Important Information Regarding Matters of Personal Injury

If you’re in an automobile accident, the following things are very important for your claim:

  1. If your condition permits, write down any statements made by the other driver and or any witnesses. This is essential, as often the other driver will say things like “I’m sorry” or “I didn’t see you” or “I was distracted”. That same person will later deny making the statement or claim not to remember saying statements that will help you on the issue of liability. Your attorney will, of course, talk to any of your passengers.
  2. If the other driver attempts to leave the scene, write down his or her license number.
  3. Unless the impact is just a light tap, call the police to come to the scene, even if there are no serious injuries.
  4. If the police don’t show up, be sure to take pictures (with your phone if you don’t have a camera) of any damage to the other car and the location of the accident.
  5. You want to have a photo of the lanes the vehicles were in at the time of impact, as there is often a dispute as to which lane each car was in (the car at fault may have tried to cut in front of you in order to turn, for example).
  6. Don’t rely on your insurance company for photos of property damage. Take your own pictures from different angles to show the severity of the impact.
  7. You are required to give a statement to your own insurance company. However, DO NOT give any statement to the other driver’s insurance company.
  8. Immediately contact your Insurance agent and file a claim under your PIP coverage. The covered amount is usually $2500 but can be much higher. PIP is cheap and you can’t be without it, as none of it has to be paid back.
